Child Safe Organisation

2.1 K and K Quality Care leadership team believe all children have the right to feel and be safe. The Leadership Team at K and K Quality Care believe keeping children safe is everyone’s responsibility. We are dedicated to providing a child safe environment where children are safe, their voices are heard and they and their families collaborate on decisions that affect their lives.

2.2 K and K Quality Care has a zero-tolerance approach to child abuse or any form of abuse impacting on any person we work with. We are committed to the safety, participation and empowerment of all children. Our first aim is to prevent child abuse through identifying risks and, as soon as possible, taking steps to remove and reduce those risks. Our second aim is to report any suspected harm to a child or young person and respond appropriately and in line with obligations with the Office of the Children’s Guardian.

2.3 The ten Child Safe Standards are:

  • Standard 1 – Child Safety is embedded in organisational leadership, governance and culture.
  • Standard 2 – Children participate in decisions affecting them and are taken seriously.
  • Standard 3 – Families and communities are informed and involved.
  • Standard 4 – Equity is upheld and diverse needs are taken into account.
  • Standard 5 – People working with children are suitable and supported.
  • Standard 6 – Processes to respond to complaints of child abuse are child focused.
  • Standard 7 – Staff are equipped with the knowledge, skills and awareness to keep children safe through continual education and training.
  • Standard 8 – Physical and online environments minimise the opportunity for abuse to occur.
  • Standard 9 – Implementation of the Child Safe Standards is continuously reviewed and improved.
  • Standard 10 – Policies and procedures document how the organisation is child safe.

3. K and K Quality Care Commitment to NDIS Practice Standards

3.1 K and K Quality Care are dedicated to ensuring the service we provide to every participant is a high quality, meets expectations, upholds the human rights and dignity of the participant and is safe and individually tailored to the needs of each person.

3.2 K and K Quality Care require all staff to undertake their work in accordance with the NDIS Practice Quality Standards.

Child Safe Standards

The Royal Commission into Institutional Responses to Child Sexual Abuse identified a framework for organisations to support and protect the
safety of children and young people. Ten Child Safe Standards were developed based on recommendations and research by the Royal
Commission and enacted into the Children’s Guardian Act NSW 2019 on 1 February 2022. The Child Safe Standards give organisations
guidance about safe child practices. K and K Quality Care are a child safe organisation, and we have a zero tolerance for any form of child
abuse or neglect.

The ten standards are:

Children’s Rights

The United Nations Convention on the Rights of the Child (UNCROC) is an international agreement on the rights of all children aged 0-18 years
around the world. Australia ratified UNCROC in 1990 and we are obliged to uphold the listed 54 articles that outline rights, which include:

  • All children are equal and have the same rights.
  • Every child has the right to have their basic needs fulfilled.
  • Every child has the right to protection from abuse and exploitation.
  • Every child has the right to express their opinion and to be respected.

Child Safe Code of Conduct

The Code of Conduct sets out safe and unsafe behaviour for staff and must be signed annually by every employee, contractor and
volunteer at K and K Quality Care. The overarching principal of the Code of Conduct is for all staff to act in the best interests of
children, young people and adults and protect them from abuse, neglect and exploitation.

The behaviours we expect from staff to keep children, young people and adults safe include:

  • Uphold the human rights for every child, young person, and adult they work with, including freedom of expression, self-determination, and decision-making in accordance with relevant laws and conventions listed in the table below.
  • Respect the privacy, confidentiality, and dignity of people of any age with disability.
  • Provide supports and services in a safe and competent manner with care and skill.
  • Act with integrity, honesty, and transparency.
  • Promptly take steps to raise and act on concerns about matters that might have an impact on the safety, health and quality of care provided to people with disability.
  • Take all reasonable steps to prevent and respond to all forms of violence, exploitation, neglect, and abuse of people with disability of any age.
  • Take all reasonable steps to prevent and respond to sexual misconduct.
  • Comply with your obligations to report any breach of the Code of Conduct by yourself, another staff member, volunteer or contractor.
  • Listen to feedback or complaints by a child, young person nor adult with openness and empathy and work collaboratively to identify resolutions to complaints that promote the safety, quality of service and rights of the individual.
  • Understand your responsibility to provide safe, effective, and quality service provision in accordance with NDIS Practice and Quality Standards and Child Safe Standards.
  • Identify and mitigate risks to participants and staff.
  • Act in accordance with Child Safe Standards and KK Quality Care Child Safe policies and procedures.
  • Behave respectfully, courteously, and ethically towards children, their families, community members and towards other staff.
  • Listen and respond to concerns of children, particularly if they communicate (verbally or non-verbally) they do not feel safe.
  • Promote and protect the human rights, safety, and wellbeing of all children working with KK Quality Care
  • Demonstrate lawful personal and professional boundaries.
  • Consider and respect the diverse experiences, backgrounds and needs of children.
  • Create an environment that promotes and enables children’s participation and is welcoming, culturally safe and inclusive for all children and their families.
  • Involve children in making decisions about activities, policies and processes that concern them wherever possible.
  • Contribute, where appropriate, to KK quality Care’s policies, discussions, learning and reviews about child safety and wellbeing.
  • Identify and mitigate risks to children, adult and staff’s safety and wellbeing as required by KK Quality Care’s risk assessment and management policy and process.
  • Respond to any concerns or complaints of child abuse, neglect, exploitation or grooming promptly and in line with KK Quality Care’s legislation as a Mandatory Reporter policy and procedure for receiving and responding to complaints.
  • Report all suspected or disclosed child harm, abuse, neglect, or exploitation as required by The Children and Young Person’s Care and Protection Act and K and K Quality Care Mandatory Reporting Policy

Complaints and Feedback

K and K Quality Care encourage all participants to provide feedback to ensure every child, young person and adult feels safe and receives high
quality service and support. K and K Quality Care believe that every complaint or feedback received provides an opportunity to continuously
improve our services, facilities, or systems for every participant.

It is the fundamental right of every participant to complain if they feel unsafe or do not receive the expected service level, and to have an
advocate assist with making a complaint.  K and K Quality Care have trained staff to respond to feedback from our participants and their family
with fairness, openness, and empathy. No child, young person or adult will ever be in trouble for making a complaint.

K and K Quality Care is committed to acknowledging complaints within two business days. There may be times where K and K Quality Care will need to meet with you, our staff and other people to resolve a complaint. K and K Quality Care are committed to trying to work out the best way to resolve the complaint within ten business days and we will let you know if we need more time and the reasons we need more time.

Diversity

NDIS Participant Rights

The NDIS Quality and Safeguards Commission was established to uphold the rights of people with disabilities receiving NDIS-funded supports. The NDIS Practice Standards and NDIS Code of Conduct outline the rights and the obligations that all NDIS service providers have to children, young people and adults.

The NDIS Practice Standards set out five Core areas of ‘Rights and Responsibilities’. These describe the rights of participants, as well as the things providers must do to show that these rights are embedded in the way they deliver services.

  1. Person-centred supports – Each participant accesses supports that promote, uphold and respect their legal and human rights and is enabled to exercise informed choice and control. The provision of supports promotes, upholds and respects individual rights to freedom of expression, self-determination and decision-making.
  2. Individual values and beliefs – Each participant accesses supports that respect their culture, diversity, values and beliefs.
  3. Privacy and dignity – Each participant accesses supports that respect and protect their dignity and right to privacy.
  4. Independence and informed choice – Each participant is supported by the provider to make informed choices, exercise control and maximise their independence relating to the supports provided.
  5. Violence, Abuse, Neglect, Exploitation and Discrimination – Each participant accesses supports free from violence, abuse, neglect, exploitation or discrimination.
